Many people think that subletting is always illegal. While that is usually not the case. Two cases can be distinguished:
- Subletting is in principle allowed if it is a part of your accommodation, and you continue to live there yourself, unless otherwise stated in the contract
- Subletting is in principle not allowed if you sublet your entire accommodation, and you are going to live somewhere else, unless otherwise stated in the lease. In this case, if you want to sublet your room / house, you will have to ask the landlord for permission. Most housing corporations will almost always approve an application if it is only temporary (for a maximum of six months).
